Terms & Conditions

The transport contract with the Bergbahnen Silvretta Galtür (in the following referred to as “Bergbahnen”) is concluded only under the terms of these General Terms and Conditions. Conflicting conditions will not be accepted. These General Terms and Conditions, the Tariff Conditions, the officially approved Conditions of Carriage and the Rules of Conduct of the International Ski Federation (FIS Rules) are part of the Carriage Contract.

The General Terms and Conditions, the Tariff Conditions and the Rules of Conduct of the International Ski Federation (FIS) are available to everyone on the Internet at www.silvapark.at and can also be consulted at the main ticket offices on request. The conditions of carriage are set out at the entrance to the lift aids and are also available for inspection at the ticket offices. When purchasing a Snow Card Tirol, the Freizeitticket Tirol or the Regio Card Tirol, their respective terms and conditions – unless they contradict these terms and conditions – also become part of the contract. The terms and conditions of these card groups are available on the homepage of the Snowcard Tirol, the Freizeitticket Tirol or the Regio Card Tirol.

The use of the lifts (cable cars and lifts) requires the possession of a valid ski pass. The Bergbahnen shall not be liable for transport to the holder of a valid ski pass if transport is impossible or inadmissible for reasons beyond the control of the cable cars. In addition to weather-related influences (e. g. strong winds, thunderstorms, heavy rain), such reasons include lack of snow, avalanche danger, official orders (e. g. in the event of a disease, epidemic, pandemic), technical defects, maintenance work or act of nature. The decision about closing down, closing the slopes, etc. is entirely at the discretion of the cable cars..

When using the transport services of the Bergbahnen, a valid ticket must always be carried and presented on request in the control zones (i. e. the entire area of the cable car, including slopes and ski routes)

The valid ski pass entitles the holder to use all operating facilities within the period of validity according to the tariff and transport conditions and these General Terms and Conditions. The ski pass is not transferable. The subsequent exchange for another ski pass and the change of the validity period are not possible. Ski passes that have not been purchased at the authorised points of sale of the cable cars, lost ski passes and ski passes that have been acquired or used improperly will be blocked. Misuse, such as unauthorized passing on of a ticket, results in the non-compensatory withdrawal and the obligation to pay a penalty of at least € 50. - and compensation for damages. The Bergbahnen also reserve the right to file criminal charges.

The individual services covered by the ski passes are provided by legally independent companies. In this case, the Bergbahnen only act as representatives of the other ski areas. Only the company in whose ski area an incident occurs is obliged to provide the individual services and to pay any damages. Contractual claims (e. g. from piste protection or transport) can only be claimed against the company in whose ski area an incident occurs.

All ski passes of the ski region Galtür in Tyrol are issued on a key card! The deposit fee is € 5.00. Undamaged, functional chip cards can be returned at the sales points of the Bergbahnen Silvretta Galtür, Intersport Wolfart, Sport Walter and at the ski pass sales points in Ischgl, Kappl and See.

The use of the services of the Bergbahnen requires different processing operations in relation to the personal data of the visitors. The visitor acknowledges and agrees to the data protection declaration of the Bergbahnen, which is posted at the ticket offices and can also be accessed here.

In the case of tickets valid for several days, Bergbahnen shall charge a mixed price if he period of validity falls in different season-times.

All prices are in EUR including the statutory VAT. Payment has basically to be made in advance. Payment options at the ski pass box office: Cash in euros, ATM card (Maestro), credit card (VPAY, VISA, Mastercard, AMEX).

 

In the event of violation of the conditions of carriage, failure to comply with the closure of ski runs (e. g. due to avalanche danger), the prohibition of skiing in forest areas or the FIS rules, you will be excluded from further carriage. In serious cases and in the event of repeated infringement, the ski pass will be revoked without replacement and a criminal complaint will be filed with the authorities. In addition, the instructions of the employees of the Bergbahnen must be obeyed, as they serve the safety and order of the ski business.

A refund of the paid ski pass will only be made in the event of an accident or illness for ski passes with a validity period of 2 days or more. The refund will be made against a processing fee of € 11,- rate from the last use of the ski pass (but at the earliest from the first day after the accident) if the ski pass is no longer used after the accident. The cash receipt and a medical certificate from a doctor practising in the ski region confirming that it is not possible to continue using the ski pass must be presented. There is no refund for accompanying persons. The refund can only be made at the cableway company from which the ski pass was purchased.

In the event of forced closure of the cable car facilities, border closure or travel warnings due to COVID-19, when the relevant official directives last until the planned end of the winter season, the following refund arrangements apply:

  • For multi-day ski passes and for day ski passes whose period of validity includes days that could have been used up until closure of facilities, the difference of the purchase price will be refunded.
    Refund amount = Ticket price – Ski pass price for days used
  • For season tickets a refund will be effected if the ticket has been used for less than 20 days. The refund will be 1/20 of the (discounted) ticket price multiplied by the number of days of skiing not used – with an upper limit of 20 days. The refund amount will be limited to 75% of the (discounted) purchase price.
    Refund amount = Ticket price/20 x (20 – days used)
  • A refund will only be made when the facilities have been closed by the authorities, when the border has been closed, or if there is an advisory warning against travel, and when this means that it is not possible to provide offers during the validity period for the respective ski pass in the ski areas and ski area members.
  • Refund amounts for multi-day ski passes are to be made in writing by 15th May 2021, and for season tickets, by 30th September 2021, to the respective sales point. After these dates there is no right to refund.

The announced start and end dates of a season as well as the announced operating hours are not seen as “fixed dates” and depend on various circumstances, such as the weather. Therefore, there is no right to a refund or extension of the ski pass even in the event of a later start of the season, an early end of the season or a reduction in operating hours. In the off-season, there could also be a limited range of lifts and slopes, especially due to the weather.

The permissible way of transport for children is regulated in the conditions of carriage of the cable cars. These conditions of carriage shall be indicated at the entrances to the lifts and shall be observed.
In general:

  • Children less than 1. 10 m can only be transported in the next seat or on the lap when accompanied by an adult.
    One adult person per child.
  • Children between 1. 10 m and 1. 25 m are only transported in the next seat when accompanied by an adult. Maximum 2 children per adult (chair lift). 
    Children over 1. 25 m in height are transported like adults.

Passes for pedestrians are only valid for transport without winter sports equipment. Pedestrians are not allowed to enter the slopes and have only to use the winter hiking trails. Tobogganing is not allowed on ski runs.

In general, nature and fellow human must be treated considerately and responsibly. This also applies when practicing sports. This also includes keeping a sufficient safety distance from piste machines, skidoos and snow-making equipment. Any pollution, throwing away from rubbish, cigarettes etc. must be avoided.

The costs of a rescue after an accident is not included in the price of the ski pass and is to be borne by the victim.

In the event of avalanche danger, ski slopes and ski routes are closed and may not be used or entered. During and after fresh snow avalanche explosions take place; during this time, it is forbidden to drive and enter affected and restricted areas.

The blocking of slopes and ski routes must be observed. Using the ski area after the pistes have closed is extremely dangerous and is therefore strictly prohibited. During this period there are regular avalanche blasting operations, and ski pistes are also groomed (at times also using winch cables which are not visible to skiers) and the pistes are not inspected by the piste service teams at that time.

Some of the facilities have web cams installed. These web cams record in real time and without sound the surrounding area (e. g. the surroundings of a mountain station, a section of a piste). The image data is broadcasted in real time on TV as well as on the website (www.galtuer.com) and the mobile app of Galtür, in order to give guests and people interested in Paznaun an up-to-date impression of the weather and piste conditions (purpose of processing). Although these web-cams have a rather wide recording range and are therefore not or only very difficult to identify persons in the recordings, it cannot be completely excluded that the web-cams may collect image data as personal data.

If and insofar as personal data are processed at all, the legitimate interests of the controller, which consist in achieving the purpose of the processing, form the legal basis for this data processing. In addition, please refer to the data protection guidelines of the cable cars, which are also available at www.galtuer.com.

Only substantive Austrian law shall apply to disputes arising from this contractual relationship. The authentic language of the contract is the German language.
